Guardianship
Q:
What is the procedure for guardianship (child is 18 with
low functioning autism)? Does the court appoint a lawyer?
A:
In Marion County the Clerk of the Court has a list of
lawyers that will do the guardianship paperwork.
Q:
Is that lawyer free?
A:
The guardianship and lawyer have to be paid by the parents
or guardian.
Q:
Are those lawyers any good?
Or is it better to hire a private one?
A:
Unless
it is a very complicated case, where money is involved, any lawyer
that does guardianships is good.
It is really up to
you.

What is the price range for handling the whole process?
A:
In Marion County price range varies from lawyer to lawyer.
There is no universal specific fee.
I've seen the price range be from a couple of hundred to
a couple of thousand dollars.
Q:
What role does SSI play in this?
A:
You may apply for SSI for your child, but SSI plays no
role in the guardianship process.
