Special
Needs Trusts Present Special Problems
The
primary duty for a trustee of a special needs trust is to protect
the trust beneficiary's eligibility for public assistance programs.
Fulfilling this duty presents the unique problem of understanding
all of the strict technical requirements for these various programs.
With the increased use of special needs trusts, finding satisfactory
trustee services is becoming more and more problematic.
Banks
and traditional trust departments are typically not attracted to
providing trustee services because special needs trusts frequently
contain insufficient assets for the financial services industry.
Even when one of these conventional institutions may agree to serve
as trustee, they simply do not understand the unconventional requirements
of protecting eligibility for public assistance programs.
By
default, family members of the trust beneficiary are normally the
next logical choice for trustee. Too often, however, family
members lack all of the necessary skills for fulfilling their fiduciary
duties. In addition, family members very often share with
banks the same lack of understanding regarding the strict technical
requirements of protecting eligibility for public assistance programs.
Special
Problems Call for Special Solutions
The
Center for Special Needs Trust Administration (The Center) is a
Florida not-for-profit corporation that offers a special solution
to the special problem of finding satisfactory trustee services.
The Center offers this solution by providing specialized trustee
services for special needs trusts.
In
addition to receiving specialized services from The Center, trust
beneficiaries also benefit because The Center requires no minimum
deposit and has no minimum annual fees for small trust accounts.
The Center protects trust beneficiaries' eligibility for public
assistance programs by engaging the services of a law firm that
understands the strict requirements of maintaining financial eligibility.
The Center also engages a registered investment advisor so that
trust beneficiaries receive the benefit and strength of professional
money management.
